SMS Privacy Policy
Nightingale College, LLC dba Nightingale Education Group (“Nightingale”) is committed to protecting your privacy. This Privacy Policy (“Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“the Service”), which we make available to you through a third-party service provider. This Policy is incorporated into the Terms of Service.
By using the Service, you agree to the terms of this Policy. Nightingale reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. This Policy, and any changes, are effective as soon as posted. Your continued use of the Service following the posting of any changes to the Policy constitutes your full acceptance of those changes.
“Personal Information” is information that individually identifies you, such as your mobile phone number or user/screen name, as well as any Personal Information that you choose to include in messages you send through the Service.
Personal Information Collected
Through the use of the Service, Nightingale will receive the following information from our third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to other users of the Service, any user or screen name that you select in connection with the Service, as well as any comments or feedback regarding the Service that you send to us.
Use of Your Personal Information by Nightingale
We use Personal Information to: (a) provide you with the Service; (b) process and respond to inquiries; (c) improve the Service; (d) if necessary, contact you with important announcements or messages; (e) conduct research; and (f) provide anonymous reporting for internal and external clients and partners.
Each message that you send through the Service (either to us or to other users of the Service) is stored on our servers. We retain these messages on our servers. Nightingale utilizes servers and services owned by third parties.
Disclosure of your information
We will not rent or sell your Personal Information to other companies or individuals unless we have your consent. We may use or disclose your information only under the following limited circumstances:
- With your consent.
- To enforce our Terms of Service.
- To trusted third parties who process information on our behalf, under agreements requiring them to follow our instructions and maintain confidentiality and security. Please note: Nightingale is not responsible if these parties fail to comply.
- We may disclose such information to any company that is controlled by, controls, or is under common control with Nightingale, for any purpose permitted under this Policy.
- To comply with legal requirements such as responding to subpoenas, court orders, or other legal processes, or to establish or exercise our legal rights or defend against legal claims.
- To address unlawful activity or security concerns, including investigating, preventing, or responding to fraud, safety threats, violations of our Terms of Service, or other legal obligations.
We may share aggregated or de-identified information that does not personally identify individuals, such as usage statistics or activity totals, with third parties without further notice.
Security
Nightingale employs commercially reasonable measures to safeguard your Personal Information, including contractual requirements that our third-party service providers implement appropriate technical and organizational security controls. Notwithstanding these efforts, no method of electronic transmission or data storage can be guaranteed to be completely secure, and Nightingale disclaims any representation or warranty that unauthorized access, disclosure, alteration, or destruction of your Personal Information will never occur.
You acknowledge and agree that your information may traverse third-party systems beyond Nightingale’s control, such as SMS delivery platforms or telecommunications carrier networks, and Nightingale assumes no responsibility for the security of such systems.
This Policy does not govern, and Nightingale shall bear no liability for, any information you voluntarily transmit or disclose to other users. You are solely responsible for refraining from sharing personal, sensitive, or identifying information with other users.
Opting In
Users can opt in by providing their phone number online, by text message, on a paper form, or at a point-of-sale location.
Opting Out
Nightingale third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” or “QUIT” to the 10-digit long code phone number used to message you.
We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.
Children’s Online Privacy Protection Rule (“COPPA”)
The Service is not intended for children under the age of 13, and Nightingale does not knowingly collect Personal Information from children under thirteen. Individuals aged 13 to 17 should not provide any Personal Information without the consent and supervision of a parent or legal guardian. By using the Service, you represent that you are at least 18 years old, or at least 13 years old and have parental or guardian consent to use the Service. The Service is intended for use by residents of the United States only.
